In a brief order Wednesday, the court said it will hear the appeal from Trump and others challenging the ruling from Judge Scott McAfee that allowed Willis to remain on the case. No trial date has been set in the sprawling election subversion conspiracy case against Trump, and the decision to consider the appeal is another sign that pre-trial efforts to delay a trial are succeeding. And the recent dramatic developments in the Weinstein case demonstrate why the presiding judge in the Trump trial, Judge Juan Merchan, needs to reverse his ruling allowing Trump to be questioned about proven misconduct from other cases. If he doesn’t, Trump could have an easy path to having a conviction in the case tossed out. This is essentially what happened in the Weinstein case. If he does not, Trump could get a conviction overturned while the ink hasn’t yet dried on the jury’s verdict.

CNN —The Supreme Court on Monday turned away Tesla CEO Elon Musk’s request to back out of a settlement agreement he struck with the Securities and Exchange Commission in 2018 over a series of tweets about the car maker that regulators alleged were fraudulent. To avoid enforcement, Musk agreed to a settlement that required him to have a company lawyer approve his social media posts about Tesla. Though he agreed to the “Twitter sitter” provision, Musk has subsequently challenged it as a violation of his First Amendment rights. The Supreme Court rejected Musk’s appeal without comment and there were no noted dissents. A US District Court and the 2nd US Circuit Court of Appeals rejected Musk’s request to declare the Twitter sitter provision unenforceable.

His lawyers say in court papers that the SEC has waged an "ongoing campaign" against Musk. The provision "restricts Mr. Musk's speech even when truthful and accurate. The SEC responded in court papers that Musk had waived his right to bringing his argument when he signed off on the settlement.

Trump’s success might make you believe that he has turned the conventional wisdom on its head – that somehow, his legal troubles are helping him politically. There isn’t much of a sign that Trump’s legal woes are helping him among the wider electorate, even if they aren’t hurting him necessarily. Consider Trump’s polling against President Joe Biden. You might think that Trump would be gaining against Biden, if the cases against Trump were helping him. It’s not clear whether the money Trump’s raising because of appeals to his base during his legal troubles is offsetting the amount his committees are spending.
